Access to and use of the Website grants the status of user (hereinafter, the “User”)
and implies full and unconditional acceptance of these Terms and Conditions.
2. Purpose
This Website is of a corporate, informational and professional nature and is intended to present the video game development studio, showcase its projects, works and activities, and provide channels for professional contact with users, collaborators,
press, investors and other interested parties.
The Website may also allow subscription to informational communications, controlled access to demos, trial versions, playtests, early content or private materials related to projects under development, as well as the management of applications to participate in technical tests or game communities.
The Website does not constitute an e-commerce platform nor a direct sales channel
for video games.
3. User registration
To access certain features of the Website, the User may be required to provide
personal data, and undertakes that such data shall be truthful, accurate, and up to
date.
ONLYHEROGAMES, S.L. reserves the right to reject or cancel registrations that do
not comply with these Terms and Conditions.
4. Early access, alpha, and beta
User participation in early access, alpha, or beta phases:
- Is voluntary and free of charge, unless expressly stated otherwise.
- Does not guarantee access to the final version of the video game.
- May be subject to technical limitations, interruptions, errors, or loss of progress.
- May be revoked at any time by ONLYHEROGAMES, S.L.
The User acknowledges that alpha, beta, or early access versions may contain errors
and may not reflect the final quality of the product.
5. Confidentiality
All content accessible during development phases, including demos, prototypes, alpha or beta versions, playtests, test servers, documentation, images, videos, gameplay mechanics, narrative elements, assets, code, balance parameters,
economic systems or any other unpublished material (the “Confidential Information”) shall be considered strictly confidential.
The User agrees to:
- not disclose, publish, transmit, communicate or otherwise provide access to any third party by any means;
- not record, capture or stream any content without the prior written authorization of ONLYHEROGAMES, S.L.;
- not perform reverse engineering, data mining or extraction of information from the software.
Any breach shall entitle ONLYHEROGAMES, S.L. to:
- immediately terminate access,
- suspend or block accounts,
- claim damages and losses incurred.
This obligation shall remain in force indefinitely even after access to the content has
ended.
6. Feedback and content submitted by the User
The User may voluntarily submit comments, suggestions, ideas, bug reports, or any
other type of feedback related to the video game.
Unless expressly stated otherwise, such feedback shall be deemed non-confidential, and the User grants ONLYHEROGAMES, S.L. a free, non-exclusive, unlimited, and worldwide license to use, exploit, adapt, and incorporate such feedback into the
video game, without any entitlement to compensation.
7. Electronic communications and use of third-party platforms
For the management and sending of electronic communications—including, by way of example and without limitation, informational communications, invitations to beta or early access phases, updates on project development, and commercial
communications—ONLYHEROGAMES, S.L. may use third-party technological platforms specialized in the management and delivery of electronic communications.
Such third parties shall, in all cases, act as data processors, accessing and processing the User’s personal data solely in accordance with the instructions of ONLYHEROGAMES, S.L., and shall not use such data for their own purposes or for
purposes other than providing the contracted services.
To the extent that the use of such platforms may involve international transfers of personal data outside the European Economic Area, such transfers shall be carried out only where appropriate safeguards required by applicable data protection
regulations are in place, including, where applicable, the adoption of Standard Contractual Clauses approved by the European Commission, the existence of an adequacy decision, or the provider’s adherence to legally recognized certification
mechanisms or frameworks, such as the EU–U.S. Data Privacy Framework, or any other instruments valid under applicable law.
The User may revoke at any time the consent granted to receive electronic communications through the unsubscribe mechanisms provided in each communication or through the means indicated in the Privacy Policy, without such
revocation affecting the lawfulness of processing based on consent prior to its withdrawal.
8. Intellectual and industrial property
All contents of the Website (including, without limitation, texts, graphics, designs, code, characters, music, logos, and trademarks) are the property of ONLYHEROGAMES, S.L. or third-party licensors and are protected by intellectual and industrial property laws.
Their reproduction, distribution, public communication, or transformation without the express authorization of the rights holder is strictly prohibited.
9. User-Generated Content
The User may create and share content related to the video games (including mods, videos, streams, screenshots, guides and fan content).
By doing so, the User grants ONLYHEROGAMES, S.L. a royalty-free, worldwide, non-exclusive, sublicensable license, for the entire term of legal protection, to
reproduce, publicly communicate and promote the video game using such content.
The User represents and warrants that such content does not infringe any third-party rights.
ONLYHEROGAMES, S.L. may remove or request the removal of any content that negatively affects the project.
10. Disclaimer of warranties and limitation of liability
ONLYHEROGAMES, S.L. does not guarantee the continuous availability of the Website nor the absence of errors, technical failures, or interruptions.
To the fullest extent permitted by law, ONLYHEROGAMES, S.L. shall not be liable for any damages arising from the use of the Website, access to beta or early access versions, or the loss of data, progress, or expected profits.
11. Personal data protection
The processing of the User’s personal data shall be governed by the provisions of
the Privacy Policy available on the Website, which forms an integral part of these Terms and Conditions.
12. Use of cookies
The Website uses its own and third-party cookies. The User may obtain detailed information in the Cookies Policy.
13. Age Requirements
The User declares that they are over 14 years of age.
ONLYHEROGAMES, S.L. does not direct commercial communications to minors.
In the case of minors, access must be carried out under the supervision of parents or
legal guardians, who shall be responsible for the use made of the Website.
14. No Employment Relationship
The User’s participation in playtests, betas, submission of feedback or community collaboration is voluntary and shall not create any employment, commercial or professional relationship with ONLYHEROGAMES, S.L., nor any right to financial
compensation unless expressly agreed in writing.
15. Amendment of the Terms and Conditions
ONLYHEROGAMES, S.L. reserves the right to amend these Terms and Conditions at any time. Any amendments shall be published on the Website and, where applicable, notified to the User.
16. Applicable law and jurisdiction
These Terms and Conditions shall be governed by Spanish law.
Unless consumer protection regulations provide otherwise, the parties submit to the
Courts and Tribunals of the city of Marbella (Málaga, Spain).
